Terms and Conditions

I. Service – Description, Charge, Conditions of Participation

These Terms and Conditions set forth a description and the terms of using the online service of TESCO-GLOBAL Áruházak Zrt. (Head Office: H-2040 Budaörs, Kinizsi út 1-3. Hungary, Company Registration Number: 13-10-040628, registered by Company Court of the Budapest Environs, VAT Number: 10307078-2-44, hereinafter referred to as “Tesco”) that is available at the website: www.tesco.hu/bevasarlas (hereinafter referred to as the “Service”).

At the website www.tesco.hu/bevasarlas, Tesco describes the products visitors can select. Information, introductions or descriptions relating to certain products are contained on the product Data / information sheet. In order to avoid any misunderstanding it is to be clearly stated that the range of products displayed on the website – including the price of individual products – is purely for information and shows the status prevailing at the time of the visit. Once he has registered, the User is capable of making a selection based on the product offerings of the (serving) store assigned to his address, which includes the products to be delivered to the User’s door by Tesco or to be collected in store by the User. Once the User has selected the products and provided other data that is required, Tesco will deliver them to the User’s door, and make an offer to the User to receive them. Instead of requesting delivery, the User can also choose to collect the selected products in a designated store, provided this service is available at the serving store. After viewing the products, the User will decide, in light of their price valid at the time of delivery (or collection at the store), whether to accept the products or part of the products. If the User decides not to accept the products or part of the products, he can reject them without giving any reason. If no product is accepted, Tesco does not charge a service charge, otherwise the service is subject to charges.

The Service can be made use of only by individuals over 18 years of age that accept the Terms and Conditions, consent to the handling and processing of their personal details, and have properly registered at the website www.tesco.hu/bevasarlas (hereinafter referred to as the “User”).

II. Change of Terms and Conditions, Entry into Force and Adoption by the User

With regard to the use of the Service– the provisions of these Terms and Conditions shall be controlling. Tesco is entitled to change the Terms and Conditions at any time. The new revised Terms and Conditions will take effect when they are published at the website www.tesco.hu/bevasarlas. The User selecting the products using the Service (i.e. creating a shopping list) will accept the amended Terms and Conditions by sending a new shopping list to Tesco after the entry into force of the amendment. If substantial changes are made to the Terms and Conditions, Tesco will notify its Users registered before by email of the entry into force of the new Terms and Conditions, which they will accept by using the Service again. Issues not regulated by this Terms and Conditions shall be regulated by the relevant provisions of the Civil Code and relevant laws applicable to agreements between consumers and the company.

III. Registration and its Modification, Suspension, Cancellation, Automatic Confirmation by Tesco

The User is entitled to select products and create a shopping list only after he has registered. During registration, the User must provide accurate and truthful information. If there is a change in the User’s information, he must immediately send a notification of this change through the User Services or via e-mail or by letter sent to the mailing address of the Service. The User may request cancellation of his registration in the same manner. Tesco shall not be liable for any damages arising from the User's failure to provide notice of change.

Tesco is entitled to cancel the User’s registration (and thus the User Account) immediately if it has reason to believe that the User is in breach of the Terms and Conditions. The cancellation of registration shall not affect the provisions of the Terms and Conditions which by their nature shall survive thereafter.

Tesco will send a confirmation email to the User within 48 hours after the shopping list is sent to it, that contains the name of the selected products, the price valid at the time of their selection, and the service charge. This automatic confirmation, however, does not constitute an offer to sell by Tesco, because it will be made to the User by Tesco at the time of delivery (collection at the store).

IV. Security

During the registration process, the User must create a password for his user account. The User is obliged to keep this password secret, and he cannot release it to any unauthorized third parties. The User is fully responsible for transactions made from his account. The User shall immediately inform Tesco, if he assumes that third persons misuse his password or have gained access to it. If the User’s such assumption is valid, Tesco will be entitled to block the User's account and at the same time to ask the User to change his password. Tesco is not responsible for any loss or damage incurred by the User as a result of the password being disclosed by the User, or being misused by either the User or a third party.

V. Clubcard

A User registered in Tesco Clubcard Loyalty Program is entitled to use his Clubcard number while registering at the website www.tesco.hu/bevasarlas . After the products have been paid, double number of points corresponding to the price of the products he actually received, valid at the time of delivery, will be credited to the Buyer’s Clubcard account.

VI. Intellectual Property Rights Protection, Use of the Website

The website www.tesco.hu/bevasarlas is owned and operated by Tesco, which is entitled to all rights (including copyright and other rights), on the basis of which it may legally dispose of the said website and its contents (including but not limited to its design, and the databases, illustrations, and prospectuses placed on it, etc.).

For the duration of their visit, Users are obliged to observe the related laws and the provisions of the Terms and Conditions, and may not impair either Tesco’s or other Users’ reputation and rights.

In particular, the User may not

  • use the whole or individual parts of the website for any purpose other than for his own use, namely, he may not copy, download, or distribute the content of the website to an extent that exceeds his own needs;
  • not interfere with and/or prevent other Users using the website;
  • interfere in any way with the content of the website and may not change its technical nature without the consent of Tesco;
  • not interfere with the security of the website;
  • use the website to send unwanted messages (spam) or chain messages, and may not send viruses or malicious or harmful programs to the website;
  • send messages to the website that contain viruses or malicious or harmful programs;
  • create false messages to falsify the identity of a User or to have access to another User’s account.

Certain parts of the Webpage, for the purpose of User identification, use so called "cookies" small data files, which are stored on the User's computer. The User is able to prevent any cookies related activities on his or her own computer by the use of the web browser; however, without the use of cookies the User may not be able to use all services on the given webpage. The User, by visiting and using certain functions of this Webpage, gives his /her consent to the storage of cookies on his/her computer and for the data handler to access such cookies. The cookies, in general, are stored for a period of 30 days, at the same time, the User may request the deletion of the cookies at any time, in addition the User, by the use of the web browser, is able to prevent any cookies related activities on his or her own computer. However, please be aware that in the latter case, without the use of cookies, certain aspects of the given Webpage may not function. In order to record the visit to the given Webpage the visitors internet address ("IP address") is logged, the storage of which data is used exclusively for statistical purposes. The data ion the logged files are not connected in any way with any personal data based on which the User ma be identifiable.

VII. Unauthorized Use of the Service

In addition to those provided in the preceding section, unauthorized use of the Service is also strictly forbidden. In particular, the following are considered unauthorized use:

  • distribute any content that is degrading, defamatory, violates human dignity, discriminative in terms of religion, belief, race or gender, supports violence or other illegal acts, or the violation of any provisions/rules;
  • distribute any content that is threatening public order, or endangers the legitimate interests of another User, Tesco, Tesco’s direct or indirect owner(s) or any of its companies;
  • gain unauthorized access to other computer systems;
  • prevent another User from making use of the Service;
  • violate public electronic communications network utilization rights;
  • disrupt networks or websites connected to the website www.tesco.hu/bevasarlas;
  • make, distribute or store electronic copies of copyrighted documents and material without prior consent from the owners.


Tesco has the right to remove harmful content from the website, as well as to claim full compensation and enforce the same against a User who caused damage to Tesco by his unauthorized use of the Service. Damage includes any damage, which has been caused to Tesco or other companies within the Tesco Group, and compensation of which is required from Tesco by third-parties for such damage, which is a consequence of the User’s unauthorized use. The damage includes both the direct damage and the costs and expenses necessarily incurred during the elimination of the fault condition caused by the enforcement of the right to compensation for damages and the unauthorized use of the Service. The fine imposed on Tesco by a competent administrative authority for the offense resulting from unauthorized use is also considered damage.

VIII. Service Availability

Tesco will do all it can to maintain and continuously improve Service quality. However, as regards the technical aspects of the Service, it is not able to guarantee to the User that the Service will be available at all time to a hundred percent degree or will operate without error. In case of technical failure, the User may report the error through the telephone User Services, or by e-mail. Then Tesco will make every effort to ensure that the error is eliminated as quickly as possible.

Tesco reserves the right to restrict Users’ access to the website www.tesco.hu/bevasarlas for as long as is necessary to carry out repairs and maintenance, as well as to develop the system or introduce new system components.

Tesco works to ensure the maximum possible availability of the Service and its gradual expansion to other regions and cities in Hungary. During his visit to the website, the User is kept informed of the current availability of the Service.

After proper information sent by email, Tesco may at any time cease to provide the Service with that the products which have already been selected by Users will be delivered.

IX. Responsibility

Despite the fact that Tesco does everything that can be reasonably expected from it to ensure the accuracy, correctness and relevance of the contents of the website www.tesco.hu/bevasarlas, it is not always able to guarantee full compliance to the User. Tesco cannot guarantee and is not responsible for mistakes, failures or technical difficulties that may arise while using the website. If Tesco discovers inaccuracies in the content, it will be obliged to correct it, provided that it is feasible.

In particular, Tesco is not responsible for the following:

  • content of websites belonging to third parties which one can visit through the website www.tesco.hu/bevasarlas, links to websites operated by a third party placed at the website www.tesco.hu/bevasarlas, other form of advertising displayed on the Service website by a third party;
  • content placed on the Service website without the knowledge or consent of Tesco, if it is not technically possible or practicable for Tesco to prevent its use;
  • incompatibility of the website www.tesco.hu/bevasarlas with the User’s terminal and software, or his connection to an electronic communications network;
  • technical difficulties, including errors and failures occurring in connection with the website www.tesco.hu/bevasarlas.


The provisions of this section do not affect Tesco’s responsibility to provide information and product liability, and its liability for implied warranty according to the existing legal provisions.

XI. Guide Price, Quantitative Differences, Costs

Guide Price

The prices shown across the website are guide prices, which mean that the prices of certain items valid at the time of delivery or collection at the stores (handover to the User) may vary from the guide prices specified on the website www.tesco.hu/bevasarlas valid at the time of creating and sending the shopping list. The guide prices shown on the website are the same as the current prices of the products available in the serving store assigned to the User’s address, that is the prices indicated at the time the products are viewed by the User.
The agreed prices are in HUF and include VAT and deposit.

Quantitative Differences

If the user does not selects a product by number of pieces (such as in case of bulk products), Tesco reserves the right to deliver the same with certain difference due to measurement inaccuracies. But, of course, Tesco will make every effort to ensure that this difference is as small as possible, that is, it is as close as possible to the quantity defined by the User.

Tesco will deliver the products for which the price is determined per unit volume (equalized weight) but which can be selected by both the quantity and the number of items as chosen by the User. If the User sends a request by number, the product price is determined according to the volume of pieces requested.

Costs

In the event that the User eventually does not accept any of the products selected, Tesco will not charge a service charge, otherwise the service is subject to charges. The service charge includes all costs related to the provision of the Service, that is, the User shall not pay any other costs in addition to that. The User is obliged to pay Tesco the service charge simultaneously with the purchase price of the products actually received. The User may find the information relating to the amount of the payable service charge on the Webpage by the delivery time periods.

XII. Availability of Products, Substitute Products

Availability of products shown on the website www.tesco.hu/bevasarlas depends on the inventory of the particular serving store, so Tesco does not guarantee continuous availability of all products. In order to ensure that the products are available to the highest possible number of Users, Tesco has the right to impose a ceiling as to how many individual items a User can purchase. In this case, the User cannot select a higher number or quantity of a product than the upper limit set by Tesco.

If the products selected by the User are not available, Tesco will endeavour to put forth its best effort to offer other products upon delivery the properties and prices of which are as close as possible to the User’s selection. Upon delivery, these substitutes will be visibly separated from the other products selected by the User, and this will also be indicated in the delivery note to be handed over to the User.

XIII. Conclusion of the Sale and Purchase and of the Service Contract

In accordance with those written in Section I of these Terms and Conditions, a contract for the purchase of the products is created between Tesco and the User only if the User accepts, that is, receives the products or part of the products recommended by Tesco upon delivery or collection at the stores. Up until then, no single statements and actions by either the User or Tesco can be interpreted as an offer or its acceptance.

A contract for the provision of the service is created through the following process:
(I) the User submits the shopping list (which includes the service charge);
(II) Tesco sends an automatic confirmation relating to the receipt of the shopping list (Section III, paragraph 3);
(III) Tesco delivers the products to the address specified by the user or provides a point of pick up at a Tesco store (Section XV)
(IV) Tesco informs the User delivered products and the payable consideration (an amount also containing the service charge and the related taxes) during which the User makes an offer to purchase them;
(V) a contract is formed by the User's receipt (taken over) of the products, the formation of the contract is verified by the receipt or the invoice issued by Tesco. The resulting contract shall be considered a non-written agreement in Hungarian, which will not be filed by Tesco.

XIV. Sending, Amendment or Cancellation of the User’s Shopping List

The User send his shopping list to be delivered to his door or collected in store by filling out the request form to be found on the website www.tesco.hu/bevasarlas. After successful registration, the User selects the products, adds them to the shopping list and provides delivery, payment and other terms and data. The request may not be amended either by the User or Tesco on the day of delivery, while Tesco will be exclusively entitled to cancel the request on the day of delivery. Tesco will deliver the products on Monday to Saturday excluding public holidays, from 08am to 10pm.

XV. Delivery and Receipt

In case of delivery to the door

When selecting the products on the website www.tesco.hu/bevasarlas, the User enters the correct delivery address and indicates the time he / she is available to take over the delivery. Tesco will deliver the products to the main entrance of the building at the address indicated in the User’s request.

The User may also request through the website www.tesco.hu/bevasarlas that the product is delivered to a particular floor or flat. Tesco is required to make every effort that can be reasonably expected from him to ensure that the items are delivered to the requested place, however, the following requirements must also be met: (a) the Delivery Assistant must have the User’s permission to enter, and (b) no obstacles may impede entry (e.g. closed main gate).

Tesco shall take all steps to ensure that the products are delivered at the requested time, but it cannot be held responsible for any delay or failure in performance which was the result of any facts and/or circumstances that Tesco may not or may influence only with unnecessary expenditures.

You need to be 18 years old to accept a delivery. If the Delivery Assistant has doubts about the age of the person receiving the products, and the person does not voluntarily present his identity document to verify his age, the Delivery Assistant will refuse to give him the products. The Delivery Assistant will do the same if the identity document shows that the person in question is under 18 years of age.

If no one receives the products selected to be delivered at the place and time designated by the User, the Delivery Assistant is obliged to leave a notice saying that he attempted delivery and to indicate that the User contact the telephone User Services to re-order delivery.



In case of collection at the stores

The User may choose not to receive home delivery, but to collect the products at the store automatically assigned to his registered address, provided that this service is available in this store. In this case, the User has to determine a date, simultaneously with sending the shopping list, when he can collect the products in the store automatically assigned to his registered address.

User cannot collect the selected products before the date specified in advance. If the User is late for his collection slot, he can collect the products, but in this case, he has to indicate this circumstance to the Tesco employee working at the designated place of collection.

To collect the products, the User has to bring his request identification number and the credit card he wants to use to pay for the goods and his ID.

You need to be 18 years old to accept a delivery. If the Tesco employee handing over the products has doubts about the age of the person receiving the products, and the person does not voluntarily present his identity document to verify his age, the Tesco employee will refuse to give him the products. The Tesco employee will do the same if the identity document shows that the person in question is under 18 years of age.

Tesco shall take all steps to ensure that the User may collect the shopping at the requested time and place, but it cannot be held responsible for any delay which was the result of any facts and/or circumstances that Tesco may not or may influence only with unnecessary expenditures.

XVI. Payment

The User may choose to pay the purchase price of the products (I) in person at the door by bank card; (II) or online. Cash payments are not accepted. Tesco does not charge a separate fee relating to the payment instrument.

The User may use Visa, MasterCard and Maestro debit cards to pay the purchase price of the products.

To reduce the risk of unauthorized access to the User’s bank card information, this information is encoded.

If the User wishes to pay online, credit card authorization (entering the details of the card) shall be carried out when the products are selected on the website www.tesco.hu/bevasarlas. During the credit card prior authorization process, Tesco will freeze HUF 700 on the User’s bank account to verify that the card is valid. Then, the total amount of the current price of the User’s shopping will be frozen on the day of delivery or collection at the stores. However, the User’s bank account will only be debited after the products are delivered. As a general rule, financial institutions debit an account using the amount that has already been frozen, so by the latter operation, the freezing is released. It is possible, however, that the financial institution does not debit the User’s account using the amount frozen, in which case the freezing continues to exist until the time indicated below despite the debit. Given that Tesco has no control over the change of such financial transactions, Tesco excludes its liability for any damage they may have caused.

If the User cancels his request according to the provisions of the Terms and Conditions, or does not eventually accept the delivery, the amount frozen as set forth in the preceding paragraph shall be released – depending on the practices of the given financial institution - within 20 working days at the latest.

Before selecting the products, the User has to ensure that the payment card is activated for online payments by the issuing bank, and verify whether his payment card will expire prior to the day when the selected products are expected to be delivered. If the User’s payment card expires on the day when Tesco delivers the products or when collection in store would take place, Tesco will not hand over the products.

If the User wants to receive a VAT invoice for the transaction, he has to announce it to the person making delivery (Delivery Assistant) upon delivery or the person present in store upon collection. The User will receive the VAT invoice by post subsequently after he has received his shopping. Each VAT invoice will be itemized.

When shopping, the User can only use eCoupons; Tesco does not accept standard coupons to use in-store and shopping vouchers (e.g. Erzsébet vouchers).

XVII. Refusal to Accept the Shopping, Withdrawal from the Contract, that is, Return of the Products

The User is entitled to refuse to accept the products or part of the products he have chosen without any reason whatsoever with that the acceptance of measured products may not be partially rejected. If User refuses to accept any product, he will not be charged a service charge. The price of rejected products is, of course, not deducted from the User’s bank account.

Furthermore, the User is entitled to cancel the contract within 14 calendar days after receipt of the products without giving a reason, which means that he may return the products received within that period without justification. In such case the User is obliged to return the product(s) in question to Tesco at the User's own expense within 14 days from the date of User's declaration on the cancelation of the contract.

Tesco is obliged to reimburse to the User the purchase price of the returned products, or -at the discretion of the User - allow the user to choose a new product for the purchase price of the returned product. (When determining the purchase price of the product paid at the time delivery shall be controlling .) Simultaneously with the return of the product and the reimbursement of the purchase price the number of points corresponding to the reimbursed price shall be subtracted from the Customer Club Card.

The User in case of cancelation of the contract is liable for the depreciation of the value of the product in question if such depreciation results from use in excess of the use necessary to determine the nature, properties and operation of the given product.

The User may not exercise this right relating to perishable foods or foods with short period of usability or freshness (such as baby foods), and relating to products in sealed packaging containing video and/or sound recordings, computer software (e.g. CD, DVD), if the User opened the packaging of products which after they are handed over, due to their nature, form an inseparable part of other products and in case of products with such sealed packaging which due to their nature cannot normally be returned (for hygienic or medical reasons) (e.g. cosmetics, lingerie, etc.) after such products have been opened , as well as for newspapers, journals and periodicals.

The right to cancelation or termination may be exercised by the use of the declaration provided in Appendix 4 or by the clear unambiguous unilateral declaration of contractual termination of the User. In case of cancelation/termination please contact our customer service department.

This section clearly shall not affect any rights which the User is entitled to in relation to complaints about defective products pursuant to the existing legislation and Section XIX of the Terms and Conditions.

XVIII. Deposit Refundable Packaging

The prices of products sold in deposit refundable packaging include the cost of the packaging material (deposit) as well. The cost of the packaging material is always indicated in the invoice. A User can return deposit refundable packaging to the designated Tesco stores and he will be repaid the deposit. Returnable containers cannot be returned directly to the person making delivery (Delivery Assistant).

XIX. Complaints

Of course, the User may refuse to accept the products that are defective for any reason at the time of delivery/receipt. If a product turns out to have been defective at the time of delivery/receipt only after it is delivered (or at least the cause of the defect already existed then), the User will be entitled to complain in this case too by calling the User Services or sending an email or by letter sent to the mailing address of the Service as well as in any Tesco store(Tesco's contact information is provided in Section XXI).

In addition to this, the User, may pursuant to Section XXI, make his / her complaint in wiring or in person relating to the conclusion of the contract, the distribution of the products and the behaviour, act or omission of the sales person. Tesco immediately investigates the oral complaints and remedies them as necessary. If the User disagrees with the handling of his /her complaint or the complaint can not be investigated immediately, Tesco will respond in 30 days to any written complaint made in this regard.

The User, in order to reach an out of court settlement in issues relating to product quality, safety, the application of rules on product liability, the quality of the service and relating to the conclusion and performance of the contract between the parties (hereinafter "Consumer Dispute") may initiate a procedure before the county (Metropolitan) arbitration board of the county / (Metropolitan) Chamber of Commerce and Industry.

XX. Miscellaneous

Information on the products presented on the website www.tesco.hu/bevasarlas is for preliminary information. The package of the product purchased (received) by the User contains all the information characteristic of the product as to its composition and use/consumption, therefore the User is required, for the sake of his own and others safety, to read and learn carefully that information.

The Terms and Conditions regulate the conditions of use of the Service, thus their provisions become an integral part of the sales contract made with the User at the time of the conclusion of the contract of sale and purchase. The Terms and Conditions are governed by the laws of Hungary.

If there is a difference between the Hungarian and English versions of the Terms and Conditions or the contents of the website www.tesco.hu/bevasarlas, the Hungarian version shall prevail.

If a court of competent jurisdiction sets out the invalidity of certain provisions of the Terms and Conditions, the invalidity of that provision shall not affect the other provisions of the Terms and Conditions, which will continue to remain in full force and effect.

If, in the event of single or repeated breaches of the Terms and Conditions, Tesco does not exercise its rights in relation to the breach of contract, it shall in no way be considered a waiver.

Appendix 2

ECoupons

I. Use of ECoupons

ECoupon can only be used through Tesco Online Service; they cannot be used in store.

ECoupons are used by entering their code under the corresponding menu item of online shopping. When eCoupons are used, a certificate of eligibility to use eCoupons may be requested.

Unless Tesco specifically provides otherwise when eCoupons are issued, (I) all eCoupons issued can validly be used only once by the User, (II) each User can use only one eCoupon, and (III) eCoupons cannot be used together with other offers or eCoupons.

ECoupons cannot be exchanged for cash or used to purchase free-gift coupons. ECoupons can be used until the end of the validity period indicated on them.

The use of eCoupons also implies acceptance of the terms and conditions for eCoupons. Tesco reserves the right to eliminate the possibility to use eCoupons at any time, for any reason, with that eCoupons already issued can be used.


II. Distribution of ECoupons

ECoupons are at all times owned by Tesco. In principle, the use of an eCoupon is linked to the User receiving it, and its use is not transferable. ECoupons may not be copied, reproduced, marketed either directly or indirectly, in any way or any means, and may not be stored in a retrieval system without Tesco’s prior written permission. Any illegal distribution and/or marketing of eCoupons (e.g. on Internet message boards or in online “marketplaces”) constitutes an invalid use, and in such cases, Tesco may refuse acceptance.


III. Items Excluded

Tesco reserves the right to exclude certain products from the scope of use of eCoupons. If such exclusion exists, detailed information about it can be found on the website www.tesco.hu/bevasarlas.


IV. Minimum Spend

If the use of an eCoupon is dependent on a minimum spend requirement, you can use such eCoupon codes only when you spend a minimum amount. Service charges are not included in the purchase amount. When the User wishes to use more than one eCoupon with a minimum spend requirement for his shopping, the requirement must be met separately for each eCoupon. (For example, if the User wants to use two eCoupons in the same transaction which are connected with a minimum spend requirement of HUF 3,000 and HUF 5,000, respectively, he is required to spend a total of at least HUF 8,000.)


V. Discount and Its Calculation

The eCoupon discount is available only in respect of the purchase of the product(s) concerned. The eCoupon discount is deducted from the total of your shopping. If the offer includes a percent discount, the Service charge will be deducted from the percent discount.

The discount is not applicable to the Service charge, unless a specific offer provides otherwise.

In case of “VAT-free” offers, prices are to be understood less VAT.


VI. Refusal of the Acceptance of ECoupons, Limitation of Liability

When using an eCoupon, the User warrants that he is the legitimate receiver of the eCoupon and at all times uses the same in good faith.

Each use, attempt or incitement to the use of eCoupons, which has resulted in ineligible persons’ receiving a discount, violates the rules of civil law and may constitute a criminal offense.

If Tesco has reason to conclude that the use of eCoupons is against the law or the provisions of the Terms and Conditions, it may refuse to accept the same. In this case, the User acknowledges that he may not make any claim against Tesco because of the refusal of acceptance. If Tesco refuses to accept an eCoupon, it will inform the User about it prior to delivery, enabling him to cancel his request.

Cancelation/Termination sample information


The User is entitled to cancel the contract within 14 days without providing any reason for the cancelation. Similarly, in case of a service agreement if the provision of services had commenced the User is entitled to cancel/terminate the contract within 14 days without providing any reason for the cancelation.

The cancelation/termination deadline shall expire within 14 days from the date the product(s) (the last product) is taken over by the User, or any third party you designate by the User for the take over other than the delivery company .”;

Ha the User intends to exercise his / her right of cancelation / termination that the User is obliged to provide his / her clear and unambiguous cancelation / termination notice to Tesco a (i.e. by way of mail (postal delivery) or electronic means) to any of the addresses indicated in Section XXI of the Terms and Conditions.

For this purpose the User may also use the below sample cancelation / termination form /declaration.

The User exercises the right of cancelation / termination, if he /she sends the cancelation / termination notice to Tesco before the expiry of the relevant deadline.

The legal consequences of the cancelation / termination



If the User cancels / terminates this contract, we shall, immediately but at the latest within 14 days from our receipt of the relevant cancelation / termination notice, reimburse the consideration paid by the User, including here delivery costs (excluding those additional costs that arose due to your selection of a delivery method that differs from the least expensive and usual method of delivery we offer). We shall make the reimbursement by applying the same method of payment used in the original transaction; unless, the User consents to a different method of payment; the User shall not bare any additional expenses arising in relation to the application of such different method of payment.

If the right of cancelation / termination is exercised simultaneously at the time of the original handover of the product in question, then the product transportation costs from your location shall be born by us (that is Tesco).

If the User exercises the right of cancelation / termination following the date / time of handover of the product(s) in question, then the User is obliged to send the product(s) in question back to Tesco to the address specified in Section …. without any unreasonable delay but at the latest 14 days from the cancelation / termination declaration is provided to Tesco The deadline shall be deemed to be met if the product(s) is mailed / sent to Tesco before the expiry of the 14 day deadline. In this case the costs associated with the returning of the product(s) is born by the User.

The User may only be held liable for the depreciation of the value of the product(s) in question, if the depreciation of the value of the product(s) results from use in excess of the use necessary to determine the nature, properties and operation of the given product.

Information relating to statutory warranty, product warranty and guarantee

1. Statutory warranty
In what cases is the statutory warranty applicable?

The User in case of faulty performance by Tesco may initiate a statutory warranty claim against the company pursuant to the relevant provisions of the Civil Code.

What rights are you entitled to based on your statutory warranty claim?

The User - at his / her own discretion- may raise the following statutory warranty claims:

The User may request repair or replacement of the product in question; unless the satisfaction of the claim raised by the User is an impossibility or if compared to the satisfaction of another claim the method of satisfying the given claim would result in a disproportionate expense to Tesco. If the User does not or could not request the repair or replacement of the product, then the User may claim the delivery / performance of proportional consideration or the User may repair the damage/error at the company's expense or have someone else repair it and in the final case the User may cancel / terminate the contract.

The User may change from his / her statutory warranty right to a different right; however, the costs associated with such change shall be born by the User; unless, it was adequately justified or the company caused the need for such change.

What is the deadline for enforcing a statutory warranty claim?

The User is obliged to, immediately but at the latest within two months from the date the defect / error is detected, inform Tesco in relation thereto. At the same time, please note that the right to file a statutory warranty claim shall expire two years from the date of the performance of the contract and thereafter such claim can no longer be made.

Against whom may the User enforce his / her statutory warranty claim?

The User may enforce its statutory warranty claim against the company.

Are there any other conditions of enforcing a statutory warranty claim?

Other than the obligation to notify the company there are no other conditions that must be fulfilled relating to the enforcement of a statutory warranty claim within six months of the date of performance, as long as the User can verify that the product or service was sold / provided by Tesco. However, after the expiry of the first six months period from the date of performance, the User is obliged to prove that the discovered defect had already existed on the date of performance.

2. Product warranty

Under what circumstances may the User enforce his/her product warranty right?

The User, in case of (product) defect of movables may at his/her own discretion is entitled to enforce the right described in Section 1 or may enforce a product warranty claim.

What rights are you entitled to based on your product warranty claim?

The User in frame of a product warranty claim may only request the repair or replacement of the product in question.

Under what circumstances shall a product be deemed defective?

A product shall be deemed defective if it fails to comply with the quality requirements of the given product applicable at the time the product is distributed or it does not comply with or have the properties described by the manufacturer in the description of the product.

What is the deadline for enforcing a product warranty claim?

The product warranty claim may be enforced within two years from the date the manufacturer distributes the product in question. This right is lost along with the expiry of the here mentioned deadline (statute of limitation).

Against whom may the User enforce the product warranty claim and what other conditions are required?

Product warranty claims may only be enforced against the manufacturer and or the distributor of the movable (product) in question. When enforcing a product warranty claim the burden to prove that the product is defective is on the consumer.

Under what circumstances is the manufacturer (distributor) released from its product warranty obligation?

The manufacturer (distributor) is only released from its product warranty obligation if it can prove that:

- id did not manufacture the product in course of the performance of its business activity or
- the defect was not detectable based on the scientific and technical knowledge at the time of the product in question was distributed or
- the defect of the product is a result of a law or a mandatory regulatory requirement.
The manufacturer (distributor) must only prove one of the above reasons not to be liable under product warranty obligation.

Please note that a statutory warranty and a product warranty claim arising from the same defect may not be enforced simultaneously and concurrently at the same time. If the product warranty claim is successfully enforced then the statutory warranty claim relating to the replaced or repaired part may be enforced against the manufacturer.

3. Guarantee

Under what circumstances can guarantee rights be enforced?

In case of defective performance Tesco is obliged to provide a guarantee based on contract pursuant to Government Decree 151/2003.

What rights is one entitled to based on guarantee and what is the related deadline?*

Repair or replacement may be requested, unless the satisfaction of the claim is an impossibility or if compared to the satisfaction of another claim the method of satisfying the given claim would result in a disproportionate expense to company. If the consumer does not or could not request the repair or replacement of the product, then the consumer may claim the delivery / performance of proportional consideration or the consumer may repair the damage/error at the company's expense or have someone else repair it and in the final case the consumer may terminate the contract.

The consumer may change from his / her guarantee right to a different right; however, the costs associated with such change shall be born by the consumer; unless, it was adequately justified or the company caused the need for such change.

When is a company exempt from its guarantee obligation?

The company may only be released from its guarantee obligation if it can prove that the defect was caused after performance of the contract.

Please note that a statutory warranty and a guarantee and a product warranty and a guarantee claim arising from the same defect may not be enforced simultaneously and concurrently at the same time; however, the consumer is otherwise entitled to the rights arsing from the company's guarantee obligation notwithstanding the rights described under Sections 1 and 2.
